The Oil Pollution Act amended the Clean Water Act to require a "substantial harm" facility to develop and implement a facility response plan (FRP). A "substantial harm" facility is a facility that, because of its location, could reasonably be expected to cause substantial harm to the environment by discharging oil into or on navigable waters or adjoining shorelines. A FRP demonstrates a facility's preparedness to respond to a worst case oil discharge.
